What Is Covered By Pennsylvania’s Workers’ Compensation?

WorkInjury15

Many workers in Pennsylvania mistakenly believe that they can receive workers’ compensation benefits for any injury they suffered at work. Unfortunately, it not true. As discussed earlier, Pennsylvania’s workers’ compensation law does not cover certain types of injuries.

If you suffered a work-related injury or were diagnosed with an occupational disease, consult with our Harrisburg workers’ compensation lawyers at Ira H. Weinstock, P.C., to review your particular case and determine whether or not your injury is covered by Pennsylvania’s workers’ compensation.

What Injuries Are Covered by Workers’ Compensation in Pennsylvania?

Under Pennsylvania’s workers’ compensation law, the following injuries and illnesses are considered compensable:

  1. Injuries that occur in the course and scope of an injured worker’s employment;
  2. Illnesses caused by exposure to toxic and harmful chemicals, fumes, dust, and other substances at work;
  3. Repetitive trauma injuries, such as carpal tunnel syndrome, resulting from repeated movements on the job;
  4. Pre-existing conditions that have been worsened by a worker’s performance of job duties;
  5. Occupational Diseases; and
  6. Loss of body parts and loss of hearing/vision as a result of work.

If a worker has suffered an injury or illness related to work, they should report the injury/illness to their employer within 120 days. While Pennsylvania law gives you 120 days to notify your employer that you were injured in a workplace accident or developed a work-related illness, it is advisable to report your injury as soon as possible.

If you wait too long, your employer’s insurance carrier is more likely to deny your claim. Consult with a skilled attorney to determine when it is the appropriate time to notify your employer of your injury.

What Benefits Can You Seek When Filling a Pennsylvania Workers’ Compensation Claim?

Under Pennsylvania law, there are several types of benefits available to workers who developed occupational illnesses or suffered injuries in the course and scope of their employment:

  • Medical benefits. These benefits cover a worker’s reasonable healthcare expenses, including the cost of medical treatment, surgery, doctor’s appointments, medication, and many more.
  • Ongoing medical bills. Workers’ compensation covers a worker’s ongoing healthcare expenses, including the cost of rehabilitation and physical therapy.
  • Travel expenses. If you need to receive medical treatment outside of the city or state where you currently live, you will be reimbursed for your travel expenses to get to and from the location where your treatment, rehabilitation, surgery, or medical examination will take place.
  • Partial disability benefits. These payments are available to workers who are not able to work at full capacity.
  • Total disability benefits. These payments are available to workers who cannot return to work in any capacity.
  • Specific loss benefits. These benefits compensate injured workers for the loss of body parts, loss of hearing or vision, or suffering permanent or serious disfigurement.
  • Death benefits. When a worker dies at work in a workplace accident or from a work-related illness, the worker’s surviving family members are entitled to death benefits.
